The petitioner is in custody since 28.04.2016 in connection with G.R.P. Kiul P.S. Case No. 29 of 2016 registered under Sections 47 of the Bihar Excise (Amendment) Act, 2016. 3.

Considering the nature of allegation made and that the issues stand settled in Cr.W.J.C. No. 533 of 2016 in which, vide order dated 26.05.2016, it has been held that Section 19 (4) of the Bihar Excise Act, 1915 (as amended by Bihar Excise (Amendment) Act, 2016), the State Government has imposed ban on wholesale or retail trade and consumption of foreign liquor by any licence holder or any person in the whole of the State of Bihar with immediate effect and this Court has categorically stated that

No.24434 of 2016 (2) dt.01-06-2016 possession simpliciter of foreign liquor has not been banned in the aforesaid section by the State, let the, petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Kiul in connection with G.R.P.
