The petitioner is languishing in custody since 18.11.2018 in a case registered for the offences punishable under Sections 30(a) & 37(b) of the Bihar Prohibition and Excise Act, 2016.

It is alleged that from the possession of the petitioner 20 litres of illicit country made liquor were recovered. It is submitted by learned counsel for the petitioner, that the petitioner has falsely been implicated in the present case and a statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent. Learned APP submits that the recovery has been made from the possession of the petitioner.

No.5718 of 2019(2) dt.01-02-2019 2/2 Considering the quantity of recovery and the period under custody, coupled with the statement made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Patna in connection with Maner P.S. Case No. 623 of 2018, corresponding to Special Case No. 10966 of 2018.
