2. The accused/petitioner is named in the FIR and apprehending his arrest in connection with Bheldi P.S. Case No.177 of 2020 registered under Sections 147, 148, 149, 341, 324, 307, 383, 333, 353, 188, 290, 341, 342 of the Indian Penal Code and Section 37(b)(c) of the Bihar Prohibition and Excise Act.
3. Allegation against the petitioner is to help the accused person in escaping him from police custody, who was apprehended in connection with violation of excise law and found in drunken condition.
4. It is submitted that the allegation qua helping

No.8401 of 2025(2) dt.06-03-2025 2/3 accused escaping from police custody is appearing very much general and omnibus against petitioner and moreover on the basis of suspicion as the petitioner along with several persons was the part of gathering, he was implicated with present case. It is submitted by learned counsel that the case of petitioner is of similar footing to that of co-accused Manish Pandey, who has already granted anticipatory bail by one of the learned co-ordinate Bench of this Court vide order dated 14.09.2021 as passed in Cr. Misc. No.1710 of 2021. While concluding argument, it is submitted that petitioner was fond involved in one criminal case, where he is on bail.

In view of aforesaid factual submission and by taking note of fact as allegation against petitioner is appearing very much general and omnibus qua helping accused escaping from police custody, accordingly, the petitioner, abovenamed, is directed to be released on bail, in the event of his arrest or surrender in the court below within a period of four weeks, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Exclusive Special Judge, Excise,
