JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 2 22-07-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in connection with Sessions Trial No. 294 of 2015 arising out of Mehandiganj P.S. Case No. 11 of 2014 registered under Sections 399 and 402 read with 34 of the Indian Penal Code and 25(1-B)(a), 26 and 35 of the Arms Act.

The prayer for bail of the petitioner was earlier rejected by this Court vide order dated 09.09.2014 passed in Cr. Misc. No. 29866 of 2014.

It has been contended that the petitioner is in custody

Patna High Court Cr.Misc. No.31805 of 2015 (2) dt.22-07-2015 2 / 2 since 14th February, 2014 and till date no witness has been examined on behalf of the prosecution during trial. It has further been pointed out that another co-accused Durga Dom whose case is identically situated to that of the petitioner has already been granted bail by this Court vide order dated 09.07.2015 passed in Cr. Misc. No. 30059 of 2015.

Regard being had to the facts and circumstances of the case as also the observations made in the aforesaid order dated 09.09.2014, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-IV, Patna City, Patna in connection with Sessions Trial No. 294 of 2015 arising out of Mehandiganj P.S. Case No. 11 of 2014.
