Heard the learned counsel for the petitioner and learned APP for the State.
It the very outset, learned counsel for the petitioner has submitted that the police have given the benefit of Section 41(1) of the Cr.P.C. He has further submitted that the final form has been submitted against the petitioner.
In view of aforesaid, the petitioner is directed to surrender in the court below and if he files an application for regular bail, that shall be disposed of on its own merit. The learned court below may take notice of the fact that the police
Patna High Court CR. MISC. No.6718 of 2022(2) dt.25-08-2022 2/2 did not require the custody of the petitioner and he was granted the benefit under Section 41(1) of the Cr.P.C. With these observations, the anticipatory bail petition stands disposed of.
Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
