The petitioner is apprehending his arrest in connection with Dumraon P.S.Case no.16 of 2018 , registered for offences punishable under Sections 147, 148, 149, 504, 323, 333, 136, 325, 326, 307, 427, 337, 338, 353, 290, 120(B) of the Indian Penal Code and Section 3 of Damage to Public Property Act. Allegation as per FIR is that a report was submitted by the Sub-Divisional Magistrate, Dumraon that in the programme

No.7643 of 2019(4) dt.17-04-2019 2/2 of VIP, the petitioner was Carcade including the local Dy.S.P. and as soon as the Carcade reached near Tin Muhani, ante social elements including the male, female and the children started abusing and also made brickbatting causing damage to the police vehicle. Petitioners are named in the FIR. Submission of the learned counsel for the petitioner is that nothing specific has been attributed against them and they have no criminal antecedent.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Buxar in connection with Dumraon P.S.Case No.16 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid observation, this application is allowed.
