Informant is not an eye-witness of the actual killing of the deceased and he claimed only to this extent that when he went near the house of the petitioner, he found dead body of his brother. The contention on behalf of the petitioner is that on the alleged date of occurrence, deceased had made an attempt to commit rape on the petitioner which was protested by husband of the petitioner but the deceased chased husband of the petitioner who jumped in a pond. The deceased not only assaulted the husband of the petitioner but also got drowned him in the aforesaid pond and after three days of alleged occurrence, dead body of husband of the petitioner was taken out from the said pond and after that Hajipur P.S. Case no. 580/2014 was lodged against the informant of the present case and others including the deceased.

Patna High Court Cr.Misc. No.32359 of 2015 (2) dt.17-08-2015 Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that petitioner is in jail custody since 4.12.2014, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in Sadar Hajipur P.S. Case no. 572/2014.
