JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 31-01-2020 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Dumraon P.S. Case No. 448 of 2019 for the offenses under Sections 272 and 273 of IPC and Section 30(a) of the Bihar Prohibition & Excise Act, 2016.

Learned counsel for the petitioner submits that in the instant case total 35.5 litres of beer was seized. He is in custody since 21.12.2019. Nothing was recovered from the conscious possession of the petitioner.

Considering the submission of the petitioner that nothing was recovered from his conscious possession, the Court is inclined to grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.

Patna High Court CR. MISC. No.4694 of 2020(2) dt.31-01-2020 2/2 50,000/-(Fifty thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cumSpecial Judge (Excise), Buxar in connection with Dumraon P.S. Case No. 448 of 2019.
