JUSTICE ASHUTOSH KUMAR ORAL ORDER 08-06-2020 The petitioner, who is in custody since 09.08.2019, seeks bail in connection with Chautarwa P. S. Case No. 202 of 2019 dated 07.08.2019, which initially was instituted for the offences under Sections 363 and 365 of the Indian Penal Code but later chargesheet was submitted under Sections 364, 302 and 201/34 of the IPC as well.

It appears from the F.I.R. that the nephew of the informant went missing, whose dead-body was found from a field. The dead-body was completely maggoteaten. After some days of the occurrence, the maternal

No.6306 of 2020(3) dt.08-06-2020 2/2 grandfather of the deceased gave a petition to the police that he suspected the hands of one Reyaz Alam and the petitioner in the killing of the deceased. Reyaz Alam and the petitioner were arrested. Later, Reyaz Alam was released on bail. The petitioner as well as the Reyaz Alam are next door neighbour of the deceased and but for suspicion, there is no other material to connect the petitioner with the aforesaid offence.

Considering the afore-stated facts, the petitioner, above-named, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 1st, Bagaha, West Champaran in connection with Chautarwa P. S. Case No. 202 of 2019.

The petition stands allowed.
