JUSTICE RAVI RANJAN ORAL ORDER 15-10-2015 Heard learned counsel for the petitioner, the State and the informant.

The petitioner seeks bail in a case registered for the offence punishable under Sections 302/34 of the Indian Penal Code.

As per the allegation, three persons including the petitioner had repeatedly assaulted to the deceased Puja Kumari and when the petitioner and his wife were trying to escape from the place of occurrence, they were apprehended by the villagers. It is contended on behalf of the petitioner that there is land dispute between the informant's husband and the petitioner as the petitioner and co-accused Ashok Singh as well as the husband

Patna High Court Cr.Misc. No.34295 of 2015 (3) dt.15-10-2015 2/2 of the informant are own brothers. It is next contended on behalf of the petitioner that there is allegation that all the accused persons had repeatedly assaulted to the deceased but there is only one injury upon the head of the deceased and it is not clear as to who had caused the same. It is further contended that wife of the petitioner has already been granted bail. The petitioner has remained in custody since 24.12.2014 having no criminal antecedent.

Learned counsel for the informant submits that the petitioner and his wife were apprehended on the spot by the villagers, however, he is unable to say that as to who had caused the fatal injury.

Considering the aforementioned facts and circumstances of the case, the petitioner, namely, Umesh Singh is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Rahul Kumar, Judicial Magistrate, 1st Class, Danapur, Patna in connection with Maner P.S. Case No.533 of 2014.
