2. This is the second attempt on behalf of the petitioner for grant of bail in connection with Suryapura P.S. Case No. 265 of 2023 registered for the offence punishable under Sections 8, 20 and 22(C) of the NDPS Act.

3. Earlier the bail application of the petitioner has been rejected vide order dated 28.06.2024 passed in Cr. Misc. No. 22106 of 2024.

4. As per the prosecution case, 21.219 Kg of Ganja was recovered from the possession of the petitioner.

5. The petitioner is in jail since 3.12.2023.

6. In the trial out of eight prosecution witnesses only one witness has been examined. The petitioner is not accused in

Patna High Court CR. MISC. No.5660 of 2025(3) dt.27-06-2025 2/2 any other case of NDPS Act.

7. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned District and Sessions Judge, Rohtas at Sasaram/concerned Court in connection with Suryapura P.S. Case No. 265 of 2023, the bailors should be the blood relative of the petitioner.

8. As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed in the trial. Noncompliance of the condition will result in cancellation of the bail bonds of the petitioner.

9. The petitioner will also mark attendance in Suryapura Police Station District- Rohtas on every Sunday of the month. Any default in appearance at the Police Station would be result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) P. Kumar U T
