JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-01-2020 Petitioner seeks bail in connection with Sasaram (Town) P.S. Case No. 794 of 2019, registered for the offences punishable under Sections 399, 402, 414 of the Indian Penal Code and Sections 25(1-B)(a), 26 and 35 of the Arms Act. Police on information of preparation of dacoity arrested petitioner and other accused persons and recovered one purse containing Rs.1100/- from the petitioner and arm was recovered from another co-accused. It further appears that petitioner is accused in three other cases.

Submission of learned counsel for the petitioner is that in all the cases he has been made accused on the basis of confessional statement of co-accused and he is in custody since 4.9.2019 and no firearm was recovered from him.

In view of above facts and circumstances, let petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Sasaram (Town) P.S. Case No. 794 of 2019, subject to the condition that he has to appear before police station of his local area in second week of every month for a period of six months, so that police may watch his conduct, otherwise his bail bonds shall be cancelled.

Let a copy of this order be sent to the Superintendent of Police, Rohtas for needful.
