JUSTICE SUDHIR SINGH ORAL ORDER 05-10-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 342, 323, 324, 376 and 511/34 of the Indian Penal Code. Allegation against the petitioner is of attempting to rape informant.

It has been submitted on behalf of the petitioner that he has got no criminal antecedent. He has been in custody since 5.6.2015. Chargesheet has been submitted in the case. There is no material to suggest regarding tampering with evidence. Injury report is Annexure-3 to the petition, same indicates the nature of injury as simple. The present case is outburst to Obra P.S. Case no. 12 of 2014.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like

Patna High Court Cr.Misc. No.33328 of 2015 (3) dt.05-10-2015 2 / 2 amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Daudnagar, Aurangabad, in connection with Obra P.S. Case no. 146 of 2014.
