JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-01-2020 This is an application for grant of anticipatory bail in connection with Akorhigola P. S. Case No. 150 of 2019, disclosing offences under Sections 307 and 324 of IPC and Section 27 of the Arms Act.
As per F.I.R. allegation against the petitioner is of firing, which hit the son of the informant, causing injury and he was taken to the hospital.
Submission of the learned counsel for the petitioner is that the occurrence is of dead of night and identification itself is doubtful. In the night there was some other occurrence took place and son of informant might have received injury in firing of that occurrence.
Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail on the ground that there is specific
Patna High Court CR. MISC. No.4495 of 2020(2) dt.23-01-2020 2/2 allegation against the petitioner is of firing, causing injury to the son of the informant.
Having heard both sides, in view of the allegations, I am not inclined to grant privilege of anticipatory bail to the petitioner. However, he has to surrender before the learned court below and make prayer for regular bail, the same shall be considered on its own merit, without being prejudiced by this order.
