JUSTICE ANIL KUMAR SINHA ORAL ORDER 17-04-2023 Heard learned counsel for the parties concerned. The petitioner has approached this Court to pay her entire arrears of salary including interest and allow her to continue to discharge her duty in Mumurabad Gram Panchayat within Noor Sarai Block, Distt. Nalanda as a Panchayat Teacher. Learned counsel for the petitioner submits that the petitioner was appointed on the post of Panchayat Teacher in Mamurabad Gram Panchayat on 9.6.2015. Learned counsel
Patna High Court CWJC No.2065 of 2023(2) dt.17-04-2023 2/2 further submits that a criminal case was registered in the year 2022 regarding appointment on the basis of fake certificates in which the name of the petitioner was also included and on that basis the salary of the petitioner was stopped and she was stopped to mark her attendance in the attendance register by the Principal of the School.
In view of the fact that the petitioner has approached this Court directly without availing the remedy before the District Appellate Authority, this application is disposed of with liberty to the petitioner to approach the District Appellate Authority within a period of one month.
It is made clear that if an appeal is filed along with condonation of delay petition, the same shall be considered by the District Appellate Authority in accordance with law. With the aforesaid observation and direction, this writ application stands disposed of.
