JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-01-2015 Petitioner is languishing in custody since 10.06.2014 in a case registered for the offences punishable under Sections 409, 420, 467, 468 of the I.P.C. It is alleged that petitioner being Secretary of Chiraibad Middle School has withdrew Rs. 2,72,000/- and Rs. 12,000/- from the account with regard to the building development account and mid-day-meal account. It is submitted by learned counsel for the petitioner that earlier with similar accusation the Headmaster of the school filed a complaint being Complaint Case No. 1147C of 2012 which was dismissed since withdrawal of the amount was made with the signature of the Headmaster and for the same withdrawal the present case has been lodged by the Block Education Officer.

Considering the aforesaid facts, let the

Patna High Court Cr.Misc. No.33242 of 2014 (3) dt.22-01-2015 2/2 petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger in connection with Bariyarpur P.S. Case No. 64 of 2013, G.R. No. 1056 of 2013.
