JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-07-2016 Heard learned counsel for the petitioner and learned counsel for the Vigilance Department as well as learned Additional Public Prosecutor for the State.

Petitioner is said to be caught by the vigilance accepting Rs.4000/- as bribe from allegation maker, namely, Prakash Kumar.

Submission on behalf of the petitioner is that the aforesaid Prakash Kumar as well as several other persons were made accused in Saraiya ( Jaitpur) P.S.Case No. 80 of 2016 and in the aforesaid case, petitioner had sustained injury.

Subsequently, the aforesaid Prakash Kumar as well as several others got bail in the aforesaid Saraiya ( Jaitpur) P.S.Case No. 80

Patna High Court Cr.Misc. No.25977 of 2016 (3) dt.04-07-2016 2/2 of 2016 and with an intent to pressurize the petitioner so that he could not give evidence in the aforesaid case, the informant in connivance with the vigilance officials got instituted this false case.

Learned counsel for the petitioner submits that at Para-7 of the petition, it has specifically been pleaded that one Indrajeet Singh is relative of the aforesaid Prakash Kumar and the said Indrajeet Singh knitted the entire game and got implicated the petitioner in this case.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Special Judge, Vigilance, North Bihar, Muzaffarpur in Special Case No. 20 of 2016 in connection with Vigilance P.S.Case No. 43 of 2016.
