2. The petitioner seeks regular bail in a case registered for the offence under Section 376 of the Indian Penal Code.

3. As per the prosecution case, the petitioner is accused of committing rape with the victim.

4. Learned counsel for the petitioner submits that petitioner is quite innocent and has not committed any offence and the petitioner is in custody since 02.10.2023.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. From the statement of the victim girl recorded

Patna High Court CR. MISC. No.8669 of 2024(3) dt.16-04-2024 2/2 under Section 164 of the Cr.P.C., it appears that the petitioner and the victim were in relationship.

7. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Purnea/concerned Court below in connection with Baisi P.S. Case No. 402 of 2023.

9. This application stands allowed.
