JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-03-2019 This is an application for grant of anticipatory bail in connection with Mohania P.S. Case No. 444 of 2017, disclosing offences under Sections 366, 34 of the Indian Penal Code. Allegation against the petitioner is of abduction of the daughter-in-law of the informant.

Submission of learned counsel for the petitioner is that during course of investigation wife of the informant and husband of the victim girl has not supported the prosecution case and the statement of wife of the informant shows that she used to flee away from the house and considering the same, one of the co-accused has been granted privilege of anticipatory bail vide order dated 19.11.2018 passed in Cr. Misc. No. 59760 of 2018.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur (Bhabua), in connection with Mohania P.S. Case No. 444 of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
