Mr. APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-03-2022 Heard Mr. Anant Kumar Mishra, learned Advocate for the petitioners and the learned APP.

The petitioners seek bail in anticipation of their arrest in connection with Sessions Trial No. 218 of 2018, arising out of Nautan P.S. Case No. 68 of 2017 dated 02.03.2017 instituted for the offences under Sections 341, 323, 324, 307, 379, 504 and 34 of the Indian Penal Code.

Over a dispute regarding construction of a house, an occurrence took place in which the informant and others are alleged to have been assaulted. Though there is specific

No.17155 of 2021(2) dt.04-03-2022 2/2 accusation of assault against petitioner no. 1 but the police submitted charge-sheet against other accused persons but the petitioners were never sent up for being tried. However, differing with the police report the court below has taken cognizance against the petitioners as well. The injury received by the informant is also reported to be simple in nature.

Regard being had to the aforestated facts, the petitioners are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge Bettiah, West Champaran in connection with Sessions Trial No. 218 of 2018, arising out of Nautan P.S. Case No. 68 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C.
