The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 25(1-B)A, 26, 27 and 35 of the Arms Act.

As per prosecution case, the informant along with police personnel were on duty and in that course, a video clip received on mobile of the informant that one person making firing by his arms and another person having with arms and further alleged that the persons who involved in the said firing identified by the local Chaukidar.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that the petitioner is the owner of the licensing

No.6327 of 2022(2) dt.16-06-2022 2/2 gun but he has never handed over the gun to his brother-in-law (Sanjeev Kumar Yadav) for opening fire in the sky on the occasion of the marriage of the daughter of one Yogendra Bhagat. The said licensing gun had already been surrendered at Vishal Gun House on 02.04.2019, a certificate is also annexed as Annexure-2 to this petition.

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid submissions, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Katihar in connection with Rautara P.S. Case No. 07 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sunil Kumar Panwar, J) Brajesh Kumar/- U T
