The petitioner is languishing in custody since 07.08.2013 in a case registered for the offences punishable under Sections 387, 420 and 120B of the Indian Penal Code. It is alleged against the petitioner that he threatened the contractors not to participate in the tender of C.P.W.D. and was managing the tender in favour of his favourate contractor and getting 5% commission in lieu of the tender. Patna High Court Cr.Misc. No.36046 of 2014 (03) dt.06-02-2015 2/3 petitioner that only on suspicion the accusation has been levelled. Though the petitioner is accused in 12 other cases, but out of them in some cases he has been acquitted.

It is submitted by learned counsel for the Economic Offences Unit that the petitioner is leader of a gang of criminals known as Shambhu-Mantu Gang.

Considering the fact that similarly situated coaccused Durgesh Kumar Roy has been granted bail by learned Special Judge and the period under custody, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Patna in connection with Economic Offence P.S. Case No. 04 of 2012.

The petitioner will appear in every fortnight before the concerned police station and will mark his attendance and the concerned police station will forward the attendance report of the petitioner to the learned court below. The petitioner will not leave the district of Patna for next one year without prior permission from the learned trial court.
