JUSTICE ASHUTOSH KUMAR ORAL ORDER 06-04-2022 Heard Mr. Sandip Kumar Gautam, learned Advocate for the petitioner and Mr. Anil Kumar, learned APP. The prayer for bail of the petitioner was earlier rejected vide order dated 04.01.2021 passed in Cr. Misc. No. 25300 of 2020.

The petitioner has renewed his prayer for bail as he has remained in custody since 10.01.2020.

A report had been called for regarding the stage of the case, which report has been received. The report indicates that two witnesses have been examined and only three are left to be examined.

Considering the nature of accusation against the petitioner and the present stage of trial, I am not inclined to

Patna High Court CR. MISC. No.7086 of 2022(3) dt.06-04-2022 2/2 grant bail to him during the pendency of the trial. Accordingly, the prayer for bail is rejected. However, if there is no substantial progress in the trial within the next six months, it would be open for the petitioner to approach the trial court for grant of bail and in that event the trial court shall be under an obligation to record the reason for the tardy pace of trial.
