JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2020 Petitioner seeks bail in connection with Mirganj P.S. Case No. 9 of 2017 (Special Case No. 64 of 2017), registered for the offences punishable under Sections 363, 366A of the Indian Penal Code and Section 4 of POCSO Act. Earlier prayer for bail of the petitioner was rejected by order dated 7.5.2018 passed in Cr.Misc.No. 14650 of 2018 by the then co-ordinate Bench of this Court.

Submission of learned counsel for the petitioner is that there is no allegation of rape or any other allegation and only allegation against him is that the girl was accompanied by the petitioner but in spite of that earlier prayer for bail was rejected.

Heard learned APP, who has opposed the prayer for bail on the ground that the girl was minor and trial has

In view of above facts and circumstances, I am not inclined to grant bail to the petitioner. However, as there is submission that four witnesses have already been examined, learned trial court is directed to expedite the trial and try to conclude it within a period of six months.

Accordingly, this application is dismissed.
