The petitioner apprehends her arrest in a case, registered for the offences punishable under Section 302 and other allied sections of the Indian Penal Code. As per the prosecution case, all the accused persons including this petitioner abused and assaulted the father of informant by means of lathi, Garasa, Farsa, as a result of which father of informant died on the spot.

It is submitted that informant is not eye-witness of the occurrence. There is land dispute between the parties and both parties are Pattidars and a tile suit is pending between them vide Title Suit No. 223 of 2019. It is further submitted that though there is allegation of assault by six persons including

Considering the facts aforesaid and the fact that though there is allegation of assault against six persons but only two injuries have been found on the person of deceased as per postmortem report and the fact that petitioner is a lady, the petitioner above-named, in the event of her arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Lauriya P.S. Case No. 34 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
