JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 25-05-2016 Heard learned counsel for the petitioner and the learned Additional Public Prosecutor, appearing on behalf of the State. This application for grant of regular bail arises out of Sahiara P.S.Case No. 61/2015, disclosing offences under sections 353, 193, 194, 195, 120B/34, 115, 182 of the Indian Penal Code. Earlier Sahiara P.S.Case No. 86/2014 was registered on the basis of statement of Dhirachand Singh alleging kidnapping of his brother Sanjay Kumar. In the said case several persons were named.
Subsequently, it transpired that Sanjay Kumar in collusion with others had concealed him for the purpose of lodging a false F.I.R., thus implicating the accused persons of that case falsely.
Patna High Court Cr.Misc. No.22961 of 2016 (2) dt.25-05-2016 recovered the said Sanjay Kumar. Sanjay Kumar @ Sanjay Singh is admittedly brother of the present petitioner, who resides in the same house.
Considering the allegation against the petitioner that he in collusion with others was instrumental in institution of false F.I.R., I am not inclined to grant him regular bail.
This application is, accordingly, rejected.
The court below is directed to expedite the trial and conclude it preferably within a period of one year. If the trial is not concluded in the meanwhile, the petitioner shall be at liberty to approach this Court to renew his prayer for bail. (Chakradhari Sharan Singh, J) Surendra/- U
