JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-01-2015 Heard learned counsel for the petitioner and the informant. The petitioner is languishing in custody since 18-6-2014 in a case registered under sections 406 and 420 of the Indian Penal Code.

It is alleged that the petitioner being the driver of the public vehicle Mahindra Bolero took the vehicle on 27-8-2013 in

No.33163 of 2014 (3) dt.09-01-2015 2 / 2 the morning at 8 A.M. and when he did not return in the night, the informant telephoned him and she was assured that he is coming with the vehicle but he did not return. It is further alleged that the petitioner informed the informant next morning that the vehicle kept in the field in front of his house has been stolen. It has been submitted by the learned counsel for the petitioner has no criminal antecedent. Statement to this effect has been made in paragraph no.3 of the petition.

The learned counsel for the informant submits that the conduct of the petitioner had not been fair as the informant was assured that petitioner was coming with the vehicle, but subsequently in the next morning the informant was informed on mobile phone that the vehicle had been stolen. Considering the submission and the period of custody, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna, in connection with Gardanibagh P.S. Case No. 289/13.
