The petitioner has preferred this application for grant of regular bail in a case registered under sections 414, 401, 413 and 120B of the Indian Penal Code.

As per allegation in the FIR, it is stated that a stolen mobile phone was recovered from the possession of accused Sumit Kumar. Two other persons including the petitioner herein were caught with Sumit Kumar and on inquiry it transpired that the three of them were dealing in sale of stolen mobile phones. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the petitioner's possession. Co-accused Sumit Kumar has been enlarged on bail vide order dated 10.11.2020 (Annexure-2). The

Having heard learned counsel for the parties and taking into consideration the grant of bail to co-accused Sumit Kumar and the petitioner having remained in custody for over 1 year, the Court directs the petitioner to be enlarged on bail in connection with Buddha Colony P.S. Case no. 96/2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Chief Judicial Magistrate II, Patna.
