The petitioner has preferred this application for grant of regular bail in a case registered under section 307 and other sections of the Indian Penal Code.

As per allegations in the FIR, over a dispute in the agricultural filed it is stated that the five named accused persons started to abuse the informant and others. All of them came variously armed and this petitioner assaulted with a sickle. It is submitted by learned counsel for the petitioner that the allegations as levelled in the FIR are false and concocted. There is case and counter case between the parties. The allegations in the FIR are not supported by the contents of the injury report which is Annexure-3 to the petition as in the

Patna High Court CR. MISC. No.17405 of 2021(2) dt.27-08-2021 2/2 opinion of the doctor the injuries have been caused by hard and blunt object. The petitioner is in custody since 26.11.2020 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the petitioner being in custody since 26.11.2020, the Court directs the petitioner to be enlarged on bail in connection with Balrampur P.S. Case no. 92 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate VI, Katihar.
