JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-03-2019 This is an application for grant of anticipatory bail in connection with Runnisaidpur P.S. Case No. 429 of 2018, disclosing offences under Sections 341, 323, 325, 307, 504/34 of the Indian Penal Code.

Allegation against the petitioner is that on the order of his mother, he assaulted the informant by rod causing injury on his head.

Submission of learned counsel for the petitioner is that earlier a case has been lodged by the mother of the petitioner against the informant and to save his skin, the present case has been lodged against the petitioner and the petitioner has no criminal antecedent. Further submission is that the informant and father of the petitioner are own brother.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Runnisaidpur P.S. Case No. 429 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
