JUSTICE SANJEEV PRAKASH SHARMA ORAL ORDER 12-01-2022 Heard the parties through video conferencing. The petitioner seeks bail in anticipation of his arrest in connection with Athmalgola P.S. Case No. 12 of 2020 instituted for the offences punishable under Sections 147, 149, 323, 325, 307, 333, 353, 385, 342, 504, 506 of the Indian Penal Code. It is a case where the police personnel who had gone to arrest two accused Mukesh Paswan and Akhilesh Paswan, when he reached their bricks and stones were pelted upon them causing injury to two persons, while others had run away. Learned counsel submits that there is no specific overt act alleged against the petitioner and they have been implicated as an accused.

In such circumstances, where police is prevented from

Patna High Court CR. MISC. No.17428 of 2021(3) dt.12-01-2022 2/2 performing its duty, it is apparent that there is no respect for law and if anticipatory bail is granted to such person, it would demoralize the police.

In this circumstances, I am not inclined to grant anticipatory bail to the petitioner.

This application is dismissed.
