ANJANA MISHRA ORAL ORDER 31-08-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.
The petitioners are apprehending their arrest in connection with Karakat P.S. Case No. 7 of 2016 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 384, 324, 325, 307 and 353/34 of the Indian Penal Code. Case diary was called for, which has since been received.
It appears that there is bona fide land dispute between the parties and occurrence took place on account of the fact that the one Kulbansh Singh, being the agnate of the petitioners, has been injured. The informant was trying to construct drain on the
Patna High Court Cr.Misc. No.23774 of 2016 (4) dt.31-08-2016 2/2 land belonging to the present petitioner. It is further submitted on behalf of the petitioner that a counter case was also lodged by the wife of one Ajay Singh, who is also a family member of the petitioners.
Having considered the aforementioned facts and that there being no cogent material in the case diary and also because the petitioners had no specific role to play in the attack on the S.I. R.N. Singh, informant of the present case, let the petitioners above named, in the event of their arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Bikramganj, Rohtas in connection with Karakat P.S. Case No. 7 of 2016 subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Anjana Mishra, J.) Ravi/- U T
