JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 25-06-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State as also the learned counsel for the opposite party no.2.

The petitioner apprehends his arrest in connection with Complaint Case No.73 of 2018 registered under Sections 147, 148, 323, 379, 498A and 506 of the Indian Penal Code. The accusation is of torturing the opposite party no.2 by her husband (petitioner) and other in-laws for non fulfillment of the dowry demand and also removing the opposite party no.2 from the matrimonial house along with her children. Learned counsel for the petitioner submits that the

In fact, the opposite party no.2 is Panchayat Teacher and the mother of the petitioner was also Panchayat Teacher, who retired from the service, and used to reside with the petitioner. The opposite party no.2 does not want to live with the petitioner and only to put undue pressure, the opposite party no.2 has lodged the present case. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Arwal, in connection with Complaint Case No.73 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
