In this case, the petitioner is seeking regular bail in connection with B.P. No. 595 of 2016 arising out of Bhagawanpur P.S. Case No.43 of 2016, registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307 and 353 of the Indian Penal Code.
The allegation is that the land has been acquired by the Railway for the purposes of construction of railway line. The villagers made protest against the construction of the railway line on the ground that they were not paid the compensation amount. The Police arrived at the place to prevent the villager to put obstacle in construction of the railway line, whereupon the villagers started assaulting with brick-kilns. The name of the
Patna High Court Cr.Misc. No.23426 of 2016 (2) dt.30-05-2016 2/2 petitioner has also been surfaced in this case. Learned counsel for the petitioner submits that the petitioner is a lady and having no specific allegation made against her. The other co-accused have been granted bail by this Court. Having considered the facts and circumstances of the case, let the petitioner-Prabhawati Devi be released on bail on furnishing bail bounds of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan in connection with Bhagwanpur P.S. Case No. 43 of 2016.
