Petitioner is in jail custody since 11.3.2016 in a case registered under section 379 read with section 411 of the Indian Penal Code.

Prosecution claims that petitioner was caught with stolen bag just after the alleged occurrence but submission on behalf of the petitioner is that an altercation had taken place between the petitioner and the informant on the point of seating in a tempo and after that informant, in collusion with the police, lodged this false case against the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that the petitioner does not have any criminal antecedent, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two
