The petitioner seeks bail in a case registered under Sections 302, 307, 353, 332, 333/34 of the Indian Penal Code and Sections-25(1-b)a, 26 and 27 of the Arms Act and Section 17 C.L.A. Act.

The prosecution case in brief is that having received information about assemblage of M.C.C., the police party reached there. Firing and counter firing took place and in consequence thereof, one SAF guard succumbed to the injury. It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 05-06-2018. Charge sheet has already been submitted. Altogether 140

Patna High Court CR. MISC. No.7540 of 2019(6) dt.17-07-2019 2/2 persons including the petitioner are named in the FIR. General and omnibus allegation has been made against the petitioner. No specific overt act is alleged against the petitioner nor any specific injury is attributed against the petitioner. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, the petitioner named above is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Aurangabad in connection with Madanpur P.S. Case No. 166 of 2008.
