JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 31-08-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the office. Heard learned counsel for the petitioner and Mr. Md. Fahimuddin, learned A.P.P. for the State.

Learned counsel for the petitioner submits that the petitioner was granted bail in this case vide order dated 13.07.2021 passed in Cr. Misc. No. 17982 of 2021 subject to the conditions mentioned therein.

Learned counsel submits that one day prior to passing of the said order, the petitioner was remanded in a case by placing an alias name of him and as a result whereof even as the petitioner was not having any criminal antecedent on the date of passing of the order by this Court, for purpose of release on bail,

No.7089 of 2022(2) dt.31-08-2022 2/2 he had to declare one criminal antecedent which was inconsistent with the statement made in the application before this Court and would have fallen under one of the conditions imposed by this Court. As a result of all these developments the petitioner did not submit his bail bonds and since then he is in custody.

Learned counsel submits that the petitioner is in custody since 26.10.2020 and at this stage he has got one criminal antecedent. Mr. Md. Fahimuddin, learned A.P.P. for the State is present.

Having regard to the facts and circumstances of the case, this Court directs that the petitioner shall be released on bail on furnishing bail bonds as indicated in the order dated 13.07.2021 passed in Cr. Misc. No. 17982 of 2021 within four weeks from today.

This application stands disposed of accordingly. Certified copy of the order will be made available only after removal of the defects.
