The petitioner apprehends his arrest in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.

16.2 litres of country made liquor has been recovered from a gunny bag and it is alleged that the same was thrown by the petitioner.

It is submitted that petitioner has falsely been implicated in this case merely on suspicion. On identification of the Spy, this petitioner has been made accused in this case. Nothing has been recovered from conscious possession of this petitioner and he has got no concern with the seized liquor.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge II-cum-Special Excise Court, Gopalganj in connection with Gopalganj Town P.S. Case No. 1016 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
