The petitioner seeks bail in connection with Chandi P.S. Case No. 350 of 2015 registered for the offences punishable under Sections 341, 323, 379, 380 and 307/34 of the Indian Penal Code.
This case has been lodged on the basis of complaint petition field by Anandi Paswan. Allegation against the petitioner is that he assaulted the informant with handle of diesel engine and further opened fire on the complainant informant with an intention to kill him but that did not hit and thereafter accused persons took away articles valuing Rs. 26,000/-.
Submission is of false implication, the occurrence
Patna High Court Cr.Misc. No.22483 of 2016 (2) dt.24-05-2016 2/2 has taken place due to cultivation dispute for payment of cost of irrigation, other co-accused have been allowed pre-arrest bail by the learned court below itself, there is no injury report in the case diary which is evident from the impugned order itself. The petitioner is suffering in custody since 07.01.2016 having no criminal antecedent and, as such, he deserves sympathetic consideration to which the learned APP opposes. In the facts and circumstances stated above, the petitioner, above named, is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Nalanda in connection with Chandi P.S. Case No.
350 of 2015, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
