JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-01-2020 Petitioner seeks bail in connection with Masaurhi P.S. Case No. 680 of 2019, registered for the offences punishable under Sections 427, 295 and 511 of the Indian Penal Code. Petitioner is not named in the FIR and allegation is of damaging idol of Lord Sani Dev and later on petitioner has been made accused in this case.

Submission of learned counsel for the petitioner is that he has falsely been implicated at the instance of his enemies and he is in custody for four months, having no criminal antecedent and charge sheet has been submitted, as such there is no chance of tampering with the evidence.

Heard learned APP also.

In view of above facts and circumstances, let

Patna High Court CR. MISC. No.5467 of 2020(2) dt.31-01-2020 2/2 petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, Masaudhi, Patna in connection with Masaurhi P.S. Case No. 680 of 2019.
