JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 24-05-2016 Heard learned counsel for the petitioner and the learned Additional Public Prosecutor, appearing on behalf of the State. This application for grant of regular bail arises out of Saharsa Sadar P.S.Case No. 17/2016, disclosing offences under sections 457, 380 of the Indian Penal Code and section 27 of the Arms Act.

The First Information Report was registered against unknown. It is alleged that from the premises of the informant, certain articles were found stolen after breaking open the gate and the lockers.

It is alleged against the petitioner that from his house eight silver coins and a golden ear ring were recovered. Learned counsel, appearing on behalf of the petitioner, has submitted that the petitioner has no criminal antecedent and in

Patna High Court Cr.Misc. No.22955 of 2016 (2) dt.24-05-2016 the F.I.R. there is no reference to the articles, which were stolen. It has further been submitted that the articles recovered from the house of the petitioner belong to his wife and are not stolen articles. The petitioner is in custody since 7.2.2016. Considering the above, this application is allowed. Let the petitioner, abovenamed, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa in Saharsa Sadar P.S.Case No. 17/2016.

This is subject to the condition that the petitioner shall present himself before the police/ court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
