In this case, the petitioner is seeking regular bail in connection with Begusarai Town P.S. Case No. 572 of 2022, registered for the offences punishable under Sections 341, 323, 307, 379, 504, 506/34 of the IPC.

The specific allegation against the petitioner is that he assaulted the informant with iron rod on his head, and he became injured.

The learned counsel for the petitioner has submitted that there is case and counter case. He is under custody since 21.10.2022. So far as injury is concerned, the opinion of the doctor has been kept reserved.

No.6623 of 2023(2) dt.10-05-2023 2/3 On the other hand, the learned counsel for the informant has opposed the prayer for bail and submitted that the case of the petitioner is not on similar footing than that of coaccused Raushan Kumar, who has been granted bail by a coordinate Bench of this Court in Cr. Misc. No. 404 of 2023. Considering the above-mentioned facts and circumstances as well as the period of detention which is about seven months, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Town P.S. Case No. 572 of 2022, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.

(iii) The petitioner shall remain
