Petitioner seeks bail in a case registered for the offences punishable under Sections 307, 302, 324/34 of the Indian Penal Code and Section 27 of the Arms Act. The allegation of commission of firearm injury to the deceased-brother of the informant is against co-accused, Sanjay Sao and Arvind Manjhi @ Terename.

Submission is that trial of Sanjay Sao has resulted in acquittal. Though there is allegation of firing against petitioner also, however, no injury was caused to anyone. Learned counsel for the informant opposed the prayer for bail.

No.7059 of 2019(3) dt.24-04-2019 2/2 assailant has already been acquitted in the trial, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Atri Police Station Case No.126 of 2011, subject to condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
