The petitioners are apprehending arrest in a case registered for the offences punishable under sections 341/323/307/34 of the Indian Penal Code and 27 of the Arms Act.

Prosecution case is that on 20.11.2015 when the informant was sleeping in his gallery at about 11.55 PM, petitioners along with co-accused Dara Singh came on a motorcycle. Petitioner no.1, Ajit Singh and co-accused Dara Singh came near the informant whereas, petitioner no.2, Pappu Singh, kept sitting on the motorcycle keeping the engine in start position when on the order of petitioner no.1 Ajit Singh co-accused Dara Singh fired on the informant

Patna High Court Cr.Misc. No.23224 of 2016 (2) dt.25-05-2016 2/2 causing injury on left side jaw.

It is submitted by learned counsel for the petitioners that accusation of firing is against co-accused Dara Singh. Considering the thrust of accusation against coaccused Dara Singh, it is a case for consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Daudpur P.S. Case No.175/2015, pending before the learned CJM, Saran at Chapra. With the above observation, this application is, accordingly, disposed off.
