2. The petitioner has prayed for bail in a case registered for the offence punishable under sections 341, 323, 324, 307, 504, 506/34 of the Indian Penal Code.
3. As per allegation in the FIR, while the informant was coming from maguraha chowk to his house, on the way, eight accused persons surrounded him and started to abuse and assaulted him by means of dagger. When his uncle, Kalam Miyam came there to rescue the informant, petitioner and others assaulted him also. Specific allegation against the petitioner is of assaulting to Kalam Miya by inflicting knife blow.
4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case due to
Patna High Court CR. MISC. No.7593 of 2024(2) dt.17-02-2024 2/2 previous land dispute. Specific allegation of assault is against co-accused Najir Miya by means of dagger to the informant. There is case and counter case between both the parties, who are agnates also and members of both side have sustained knife injuries. Petitioner has got no criminal antecedent and languishing in judicial custody since 28.6.2023.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned ACJMII, Bettiah, West Champaran in connection with Gaunaha P.S. Case No. 111 of 2022.
