The petitioner has preferred this application for grant of regular bail in a case registered under section 395 of the Indian Penal Code.
As per the prosecution case, six accused persons on two motorcycles dispossessed the informant of his motorcycle. It is submitted by learned counsel for the petitioner that the FIR was registered against unknown. The name of the petitioner transpired in the confessional statement of co-accused made before the police. The petitioner was arrested from his house. The police has wrongly shown recovery of the motorcycle from his house and forcibly recorded a confessional
Patna High Court CR. MISC. No.16989 of 2021(2) dt.26-08-2021 2/2 statement alleged to have given by him. The petitioner is in custody since 6.7.2020 and chargesheet has been submitted in the case without putting the petitioner on T.I. parade. Heard learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the period in custody, the petitioner having not been put on T.I. parade and the investigation in the case having concluded, the petitioner is directed to be enlarged on bail in connection with Mairwan P.S. Case no. 116 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan.
