2. The petitioner is in custody since 12.1.2016 in connection with Pupri P.S. Case No.135 of 2011 for the alleged offences under Sections 341, 323, 324, 448, 34 of the Indian Penal Code.

3. It is submitted that the petitioner has been falsely implicated on mere suspicion and only on the ground that he used to visit banana shop of the deceased prior to his death. The F.I.R. is against unknown persons.

4. Learned A.P.P. submits on the basis of paragraph-18 onwards of the case diary that the name of the petitioner along with other accused persons has come. However,

Patna High Court Cr.Misc. No.24749 of 2016 (3) dt.21-07-2016 2/2 he also refers to paragraph-22 of the case diary according to which the mobile phone of the deceased was being used by one Md. Ali Akbar with his own Sim Card.

5. Having regard to the entirety of the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned C.J.M., Sitamarhi in connection with Sursand P.S. Case No.257 of 2015 with the additional conditions that the petitioner shall remain personally present on each and every date and during trial and in the event of failure on two consecutive dates, his bail bond shall be liable to be cancelled by the learned Court concerned and one of the bailors will be the close relatives of the petitioner.
