Let the defect(s), if any, be removed within four weeks from today.

The petitioner seeks regular bail in connection with Rail Jhajha Police Station Case No. 135 of 2021 instituted for the offences punishable under Sections 379 and 411 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is in judicial custody since 21.11.2021, charge-sheet has already been submitted and has criminal antecedent of one case.

The prosecution case in short is that the informant boarded in general bogie at Gidhour Railway Station when the

No.6335 of 2022(2) dt.13-06-2022 2/2 train was about to move then suddenly one person came to the informant and taken away his mobile from his pocket and jumped from the train. The informant raises alarm of chor-chor and he also jumped from the train and chased the accused and caught him and thereafter Railway employees also arrived there and on inquiry he disclosed his name as Sant Kumar. Police officer searched his body. During search, one theft mobile of Realme company with sim was recovered from his pocket and also a knife, was recovered from his pocket.

Considering the facts that the petitioner is in custody since 21.11.2021, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) only with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kiul in connection with Rail Jhajha Police Station Case No. 135 of 2021.
