Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.

According to the prosecution case itself, no one has seen the actual killing of the deceased and the name of the petitioner was given by the informant only on the basis of previous enmity and land dispute.

Moreover, one co-accused Karan Singh, having more or less similar allegation, has already been granted privilege of bail. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge V, Munger in Sessions trial no. 216/2015 arising out of Bariarpur P.S.
