JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-02-2020 Petitioner seeks regular bail in connection with Tedhagachh P. S. Case No. 144 of 2019 giving rise to Special Case No. 410 of 2019 registered for the offence(s) punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2016. Allegation is that there is a recovery of 168 liters of liquor from the petitioner and some other accused persons who have carrying the same in their bags.

Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case which will appear from the seizure list in which the signature of the petitioner was not obtained. He is no criminal antecedent and is in custody for more than 2 months. Charge-sheet has already been submitted, as such, there is no chance of tampering with the evidence.

Having heard both sides, in view of the submissions, made above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional District and Sessions Judge2nd-cum-Special Judge, Excise, Kishanganj, in connection with Tedhagachh P. S. Case No. 144 of 2019 giving rise to Special Case No. 410 of 2019.
